1. Who we are
Margin Assist is a sole-trader business operating in Melbourne, Victoria (ABN 76 657 207 177). In this policy, "we", "us" and "our" refer to Margin Assist; "you" refers to a client, prospective client, or visitor to this site.
We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains what information we collect, why, how we store it, who we share it with, and the rights you have over it.
2. Information we collect
When you fill in our contact form we collect:
- Your name, email address, and phone number
- Your business name and suburb
- Your monthly card volume range and current surcharge percentage
- Any optional notes you choose to share
During a paid engagement we additionally collect, with your authorisation:
- Your last three monthly merchant statements (PDF or CSV)
- Read-only or temporary owner-revocable access to your point-of-sale system
- Logins or partner-access credentials for your online ordering platforms
- Your current menu or pricelist, logo, and brand colours
- Details of your existing merchant agreement (term, exit fees, terminal rental)
3. Why we collect it
We collect this information for one purpose: to deliver the engagement you have asked us to deliver. Specifically, we use it to:
- Respond to your enquiry and arrange a free audit conversation
- Confirm the engagement clears our money-back guarantee threshold
- Carry out the effective rate audit, provider comparison, repricing plan, POS and online migration, and customer communications pack
- Send invoices and engagement-related correspondence
We do not use your information for marketing or sales activity outside the engagement, and we do not on-sell or share your data with third parties for marketing purposes.
4. How we store it
Information you provide is held in encrypted storage that only the two founders working on your engagement can open.
Merchant statements are deleted within 14 days of handover. We do not retain raw statement data after the engagement closes. We only keep the audit summary required for our own records.
Engagement records (invoices, agreements, audit summaries) are retained for the period required by the Australian Taxation Office for sole-trader bookkeeping (currently five years).
5. Confidentiality and NDA
All client information is treated as confidential. A written one-page service agreement is signed before any login or merchant statement is shared. A separate non-disclosure agreement is available on request before that point.
We carry professional indemnity and public liability insurance covering the engagement.
6. When we share information
We share your information only in the following cases, and only to the extent necessary:
- Registered BAS-agent partners. Where the work touches tax matters and needs an expert sign-off, we partner with a registered BAS agent. We share only the information required for that sign-off, and only with your prior consent.
- Point-of-sale provider partner programs. If our provider comparison recommends a switch and you accept it, we may send a referral to the chosen provider (Tyro, Smartpay, Square, Zeller, or similar). We disclose any referral fee we receive at the point of recommendation.
- Form processing. Submissions to our enquiry form are processed by Formspree on our behalf. Their privacy policy is available at formspree.io/legal/privacy-policy.
- Hosting infrastructure. This website is hosted by Cloudflare Pages, which receives standard visit information (IP address, time, browser type). We do not access these logs as a matter of course.
- Legal obligations. Where we are required by law (ATO records, court order, or similar).
7. Cookies and analytics
This site doesn't track you. We don't set tracking cookies, don't run analytics, and don't use advertising pixels. The only data leaving the site through normal browsing is the standard visit information described above.
8. Your rights
Under the Australian Privacy Principles you have the right to:
- Access the personal information we hold about you
- Ask us to correct it if it is inaccurate or out of date
- Ask us to delete it where we are not required to retain it
- Lodge a complaint about our handling of your information
To exercise any of these rights, email margin.assist.melbourne@gmail.com. We respond within 30 days.
If you are unhappy with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
9. Updates to this policy
We may update this policy. The version in force for your engagement is the version current on the date of your booking confirmation. Material changes will be communicated by email to active clients.
